MaxCalo is operated by Thao Ngo, located in Vietnam ("we", "us", or "our").
These Terms of Service ("Terms") govern your use of MaxCalo. By using MaxCalo, you agree to these Terms.
You must be at least 13 years old to use MaxCalo. If you are under the age of majority, you need parent or guardian consent.
MaxCalo provides meal logging, calorie and macro tracking, optional AI analysis, Apple Health integration, optional iCloud sync, and premium subscriptions. Features may change at any time.
MaxCalo is for general wellness only. It is not a medical device and does not provide medical, dietary, or professional health advice. AI nutrition estimates may be inaccurate. Consult a qualified professional for health decisions. You use MaxCalo at your own risk.
Your data is primarily stored on your device and, if enabled, synced through your Apple ID. The app also creates an anonymous identifier with Google Firebase to operate AI scanning and diagnostics. You are responsible for device security, backups, and the accuracy of information you enter.
MaxCalo may offer limited free AI scans and other free features. Premium subscriptions are billed through Apple, auto-renew unless canceled at least 24 hours before the end of the current period, and are managed in your Apple ID settings. Refund requests must be made to Apple.
You may not misuse the Service, violate law, interfere with operation, exceed intended usage limits, or infringe third-party rights. We may suspend access for violations.
You retain ownership of content you submit. AI scanning transmits selected meal images and your fitness goal to service providers for analysis. You are responsible for your content and decisions based on app information.
MaxCalo and its materials are owned by us or our licensors. You receive a limited personal license for non-commercial use in accordance with these Terms and App Store rules.
Apple, Google (Firebase), OpenAI, RevenueCat, and other providers have their own terms. We are not responsible for third-party services outside our reasonable control.
Your use of MaxCalo is also governed by our Privacy Policy.
To the maximum extent permitted by law, MaxCalo is provided as is and as available without warranties of any kind, including accuracy of nutrition estimates or uninterrupted operation.
To the maximum extent permitted by law, we are not liable for indirect or consequential damages. Our total liability is limited to the greater of amounts you paid in the prior 12 months or USD $50.
You agree to indemnify us for claims arising from your use of MaxCalo, your content, or your violation of these Terms.
You may stop using MaxCalo at any time. We may suspend or terminate access for violations, legal requirements, or service discontinuation.
We may update these Terms. Continued use after updates become effective constitutes acceptance.
These Terms are governed by the laws of Vietnam, subject to mandatory consumer protections in your country of residence.
If you obtained MaxCalo from the App Store, Apple is not responsible for the app or support, and Apple is a third-party beneficiary of these Terms.
