PushUpFly is operated by Thao Ngo, located in Vietnam ("we", "us", or "our").
These Terms of Service ("Terms") govern your use of PushUpFly. By using PushUpFly, you agree to these Terms.
You must be at least 13 years old to use PushUpFly. If you are under the age of majority, you need parent or guardian consent.
PushUpFly is a camera-controlled game in which your push-up movement flies a bird through pipes. Features may include difficulty levels, on-device score tracking, optional replay preview, and optional share or save to Photos. Features may change at any time.
PushUpFly requires Camera permission to track push-ups. You are responsible for a safe play space, clear framing, and how you exercise. PushUpFly is a game, not medical advice or fitness coaching. Go at your own pace and stop if you feel pain. You assume the risks of physical activity while using the app.
PushUpFly does not require a user account. Pose tracking and gameplay processing run locally on your device. Scores and preferences are stored on device. You are responsible for device security and for anyone you share replays with.
Optional replays and snapshots stay on your device unless you share or save them. Saving to Photos requires your permission. Sharing uses the system share sheet and is initiated by you. We do not upload your camera feed or replays to our servers.
PushUpFly may offer free features and optional in-app purchases or subscriptions. Any paid items are billed through Apple, auto-renew if applicable unless canceled at least 24 hours before the end of the current period, and are managed in your Apple ID settings. Refund requests must be made to Apple.
You may not misuse the Service, violate law, interfere with operation, reverse engineer the app except where permitted by law, or infringe third-party rights. We may suspend access for violations.
You retain ownership of replays and snapshots you create. PushUpFly does not claim ownership of that media. You are responsible for having the right to share content that includes yourself or others.
PushUpFly and its materials are owned by us or our licensors. You receive a limited personal license for non-commercial use in accordance with these Terms and App Store rules.
Apple, Google (Firebase), RevenueCat, and other providers have their own terms. We are not responsible for third-party services outside our reasonable control, including destinations you choose when sharing.
Your use of PushUpFly is also governed by our Privacy Policy.
To the maximum extent permitted by law, PushUpFly is provided as is and as available without warranties of any kind, including accuracy of pose tracking, scoring, replay capture, fitness outcomes, or uninterrupted operation.
To the maximum extent permitted by law, we are not liable for indirect or consequential damages, including injury from exercise, loss of media, or device issues. Our total liability is limited to the greater of amounts you paid in the prior 12 months or USD $50.
You agree to indemnify us for claims arising from your use of PushUpFly, your shared content, or your violation of these Terms.
You may stop using PushUpFly at any time by deleting the app. We may suspend or terminate access for violations, legal requirements, or service discontinuation.
We may update these Terms. Continued use after updates become effective constitutes acceptance.
These Terms are governed by the laws of Vietnam, subject to mandatory consumer protections in your country of residence.
If you obtained PushUpFly from the App Store, Apple is not responsible for the app or support, and Apple is a third-party beneficiary of these Terms.
